New Regulations for Environmental Site Assessments For Commercial Properties 

New Regulation for Environmental Site Assessments Recent amendments to the Ministry of Environment (MOE) regulations have created significant changes to Environmental Site Assessments (ESA) affecting Purchasers and Sellers of industrial properties in the GTA. The new regulations require Phase I ESA’s to investigate the complete historical uses of all properties within 250 meters (instead of investigating just the immediate neighbours). These changes will result in better quality reports industry wide. Plan on 3-4 weeks and $3,000-$4,000 cost per report. In addition, the new regulations on how Phases I’s are prepared will result in more Phase II ESA’s being recommended. The new regulations have also imposed lower thresholds for the most common pollutants.It is expected that these new regulations will result in more industrial sites will be deemed ‘contaminated’.
